Immigration attorneys, businesses considering EB-5 capital, those wishing to establish EB-5 Regional Centers and existing EB-5 Regional Centers are invited to a one-day EB-5 workshop to be held in Chicago on August 30, 2010.

 

The EB-5 immigrant visa program was created to attract immigrant investors to the United States to invest capital, create jobs and stimulate the economy.  The workshop is designed for:

 

·       Immigration attorneys:  The EB-5 program is a highly beneficial permanent residence option for the wealthy individual.

·       Businesses considering EB-5 capital:  Given the current condition of the credit market, the EB-5 Investment Visa may be the answer for businesses that lack traditional capital options.

·       Those wishing to establish EB-5 Regional Centers:  More than 90 percent of EB-5 investment is conducted through federally approved Regional Centers.

·       Existing EB-5 Regional Centers:  Topics include properly setting up escrow accounts, drafting USCIS-compliant business plans, Regional Center administration and properly structuring your EB-5 enterprise.

 

The EB-5 Regional Center program is one of the most complex and misunderstood government programs in existance today.  When a Regional Center is structured correctly, it can be a powerful tool for raising foreign investment capital at attractive rates.  When done poorly, it can be a long hard road that is very capital intensive and leads to government entanglement.

 

We will be bringing together experienced EB-5 professionals that are responsible for authoring more than 15 Regional Center applications, as well as numerous project specific business plans and econometric analyses.

Joseph C. McCarthy, MS JD - Immigration Law

 

Mr. McCarthy's primary area of legal expertise is Immigration Law, including all facets of EB-5 Regional Center and foreign investor immigration applications.  He is an active member of the American Immigration Lawyers Association (AILA) and has successfully recieved USCIS approval for multiple EB-5 Regional Centers throughout the United States.  Mr. McCarthy is currently the chairman of the legislative committee of "Invest in United States of America (IIUSA)".  As chairman, Joseph is responsible for leading lobbying efforts and to represent all Regional Centers to the United States Congress.  Mr. McCarthy holds a law degree with honors from Seattle University School of Law, an M.S. in Hydrology & Aqueous Geochemistry from the Colorado School of Mines, and a B.A. in Geology from Whittier College.

 

Kevin Wright - Econometrics and Project Planning

 

Mr. Wright is considered one of the foremost experts on the EB-5 Immigration Visa program.  As an accomplished researcher, analyst and professional author, Kevin has assisted many entrepreneurs in receiving Regional Center designation and subsequent approval of the specific projects that are developed and put into operation through the Regional Center mechanism.  As an IMPLAN software specialist, Kevin has authored numerous econometric analyses, in many divergent industries, that demonstrate the employment and economic impacts of these various projects to USCIS.  The Regional Center application process requires Kevin to have an expertise in business plan writing, econometric analysis, and the complexities of government reporting requirements coupled with the "hands on" experience necessary to successfully work within this highly-specialized industry.  Suzanne Lazicki – Business Plan Writer 

 

Suzanne Lazicki does business as Lucid Professional Writing, a service specializing in business plans to be filed with USCIS. Since 2009 she has worked with eleven EB-5 Regional Centers and has prepared business plans in connection with L-1, E-2, and stand-alone EB-5 petitions. She writes a blog of news related to the EB-5 program and regularly participates in EB-5 stakeholder events. Suzanne has over ten years of business experience, a B.A. in English Literature (summa cum laude), an intermediate A level certificate in Mandarin Chinese, and a high level of proficiency in office and design software programs. She has written business plans and feasibility studies for enterprises around the USA and on three continents, and for ventures ranging from real estate development to manufacturing to agriculture. Suzanne is based in Pasadena, California.

Jor Law - Corporate Law

 

Mr. Law practices corporate and business transactional law in Los Angeles and is a founding shareholder of Homeier & Law, P.C.  His legal expertise is in the areas of finance, secured and unsecured lending, mergers and acquisitions, licensing, securities, venture capital, internet and new media, technology and e-commerce in addition to corporate transactional law.  Mr. Law advises clients on corporate and secuities aspects of EB-5 related transactions.  In this capacity, Mr. Law represents EB-5 investors as well as businesses seeking capital through the Regional Center EB-5 program.  Mr. Law is a frequent presenter at EB-5 industry events, such as conferences held by the American Immigration Lawyers Association, State Bar of California and the Los Angeles County Bar Association. 

Michael Homeier - Corporate Law 

Mr. Homeier is a founding shareholder of Homeier & Law, P.C.  His legal expertise is in the areas of general business, corporate, transactional and business financing.  With over 25 years' experience in the corporate and business transactional fields, as in-house counsel and with private law firms, Mr. Homeier brings a wealth of legal knowledge and expertise to the EB-5 industry.  Mr. Homeier assists Regional Centers with structuring their EB-5 transactions as well as the negotiation and drafting of business and securities documents relevant to the EB-5 program.  These documents include investor questionnaires, operating agreements, limited liability agreements, loan agreements, subscription agreements, private placement memoranda (PPMs) and escrow agreements.  Michael actively participates in public speaking engagements, both in the EB-5 business financing and business law arenas and as an inspirational speaker to teenaged and young adult cancer survivors on post-treatment life success.  Mr. Homeier received his J.D. from the University of Southern California and his B.A. from the University of California, Los Angeles.  Mr. Homeier is a member of the State Bar of California.

 Brian Terwilliger - Escrow Agent 

Brian Terwilliger is currently the Vice President of business development at NES Financial specializing in complex multiparty escrows.  Mr. Terwilliger has been in the escrow and exchange business for twenty four years.  His experience includes business development, administration, and managing groups specializing in complex corporate escrow transactions, 1031 exchanges, tax-exempt debt financing, institutional custody, and mortgage custody.  Prior to joining NES Financial, Mr. Terwilliger was with JPMorgan Chase and its predecessor banks.

 

Brian has a Finance degree from Illinois State University, and an MBA from Lake Forest Graduate School of Management.  In his spare time, when not with his family, he is an avid runner and just completed his first Boston Marathon.

 

Peter Joseph - IIUSA Interim Executive Director

 

Mr. Joseph is the Interim Executive Director at the Association to Invest In the USA (IIUSA).  IIUSA is a 501(c)(6) not-for-profit industry trade association, formed in 2005, made up of Regional Centers, attorneys, consultants and other EB-5 service providers.  IIUSA is dedicated to being a unified voice for making the EB-5 Regional Center program permanent.  IIUSA retains representation in Washington, DC to advocate the Association's positions to Congress, USCIS and other pertinent federal agencies.  Furthermore, IIUSA works to establish the EB-5 regional Center program as a niche industry by developing, promoting and maintaining best practices and industry standards. 

Mr. Joseph has been involved in various aspects of the EB-5 Regional Center program, starting in 2007, when he worked for a leading EB-5 law firm as a Legal researcher.  In this position, he aided in the submission of applications for regional Center designation, I-526 petitions, I-829 petitions, appeals, etc.  Mr. Joseph has worked for IIUSA since February, 2008 and was named Interim Executive Director in February, 2010.  Under his leadership, IIUSA has continued to expand its membership base and influence, building momentum for Congress to make the EB-5 program permanent giving the program the certainty to fulfill its job creation potential.  Mr. Joseph graduated from Ithaca College in 2007 and is enrolled in the DePaul University School of Public Service Leadership and Policy Studies (LPS) Master's Program.

 Mr. Joseph will be speaking about the IIUSA and the EB-5 regional Center program.

Michael Gibson - Regional Center Analyst

Mr. Gibson is the founder of USAdvisors.og.  USAdvisors.org is the source for news, projects and information about EB-5 Regional Centers and their investment projects.  They are analysts, economists, accountants, statisticians and mathematicians that produce EB-5 Regional Center project comparative analysis reports for foreign national investors based on topics covering job creation methodology, the strategic plan, management, risk factors, risk mitigation, safety, return, exit strategy, escrow and industry overview among many others.  

 

Brian Su - Regional Center Marketer  

Mr. Su is an accomplished entrepreneur/business development expert knowledgeable in all aspects of international business strategy and marketing since 1987. He has extensive experience in International investment business development, marketing, management, and strategic planning. Mr. Su has been instrumental in establishing a network of immigration brokers and investors in China, South Korea, India and other Asian countries.  Mr. Su is a leading authority in EB-5 marketing in Asia, operating the EB-5 Marketing and Field Support Center in China. His clients include: Idaho State Regional Center, Lake Buena Vista Resort Regional Center, Los Angeles Regional Center, the State of Vermont Regional Center projects,  Orlando EB-5 Investment Center, Palm Coast Regional Center, California Energy Investment Center, Cleveland International Fund Regional Center, to name just a few.
